Section 22 Income Tax Act is crucial for individuals who have taken home loans in India. This section allows deductions on the interest paid on loans used to purchase or construct property, making home ownership more accessible by reducing the tax burden. With increasing housing prices, these tax benefits come as a significant relief for many taxpayers. As home loans remain one of the most common financing options for home buyers, understanding the full potential of Section 22 can help save thousands of rupees annually.
Section 22 of Income Tax Act offers tax relief to individuals who have borrowed funds to acquire, construct, repair, renew, or reconstruct a property. It is essential to note that this benefit applies to income generated from house property, even if it is self-occupied or let out. The interest paid on the home loan can be claimed as a deduction under Sec 22, significantly lowering your taxable income.
There are two major categories under which deductions are allowed—one for self-occupied properties and the other for let-out properties. For self-occupied properties, the maximum deduction under sec 22 is capped at ₹2 lakh. On the other hand, if the house is rented or let out, the entire amount of interest paid can be claimed as a deduction. However, the total loss from house property that can be set off against other heads of income (like salary) in the same financial year is limited to ₹2 Lakhs; any remaining loss can be carried forward for up to 8 subsequent years to be set off against future house property income.
Kindly note, Under the new (default) tax regime, deductions for interest on loans for self-occupied properties are not available. However, the deduction for the full interest amount on loans for let-out properties is still permitted under the new regime. Taxpayers can choose between the old and new tax regimes based on their financial circumstances to maximize their benefits.
Exceptions under Section 22 of the Income Tax Act
While Section 22 Income Tax Act offers substantial relief, it has certain conditions. Firstly, the deduction for a self-occupied property is capped at ₹2 lakh annually. This means that even if the interest paid exceeds this limit, you cannot claim more than ₹2 lakh for self-occupied homes. However, there is no upper limit on the interest deduction for rented properties, making it an appealing option for those with let-out properties.
Secondly, there is a stipulation regarding the completion of construction or acquisition. The loan must be used to purchase or construct a property, and the construction should be completed within five years from the end of the financial year in which the loan was taken. If the construction is not completed within this time frame, the deduction under Section 22 gets reduced to ₹30,000 instead of ₹2 lakh for self-occupied properties.
Additionally, the deduction for the pre-construction period is available, but only for five equal instalments after the property’s construction is complete.
Deduction of Interest on Home Loan for Property
The most popular benefit under Section 22 of the Income Tax Act is the deduction on interest paid on home loans. This is particularly beneficial for individuals who have borrowed money to buy or construct a house. As mentioned earlier, the maximum deduction allowed for self-occupied properties is ₹2 lakh annually, provided the construction or acquisition is completed within five years. There is no upper limit for let-out properties.
